These Terms of Service ("Terms") govern your access to and use of the ElevaTechPro platform and related services operated by ElevaTechPro, Inc. ("ElevaTechPro," "we," "us," or "our"). Please read them carefully before using the platform.
By creating an account, accessing, or using the ElevaTechPro platform, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the platform.
These Terms apply to all users of the platform, including account administrators, dispatchers, technicians, and building managers with portal access.
ElevaTechPro provides a cloud-based Software-as-a-Service (SaaS) platform for elevator maintenance management. The platform includes work order and dispatch management, ASME A17.1 inspection checklists, jurisdiction compliance tracking, technician mobile applications, customer portal, billing and invoicing, and integrations with third-party services including QuickBooks, Stripe, SendGrid, and Twilio.
The platform is operated on a multi-tenant architecture. Each subscriber's data is logically isolated from other subscribers using application-layer controls and database-layer Row-Level Security. ElevaTechPro reserves the right to modify, expand, or discontinue features with reasonable notice.
To use ElevaTechPro, you must create an account. You agree to:
You are responsible for all activity that occurs under your account, including actions taken by technicians and other users you add to your account.
ElevaTechPro is offered on monthly and annual subscription plans. Subscriptions begin on the date you activate your account and renew automatically at the end of each billing period unless cancelled.
Your subscription will automatically renew at the then-current price unless you cancel at least 30 days before the renewal date. Cancellation requests must be submitted in writing to [email protected] or through the Settings > Billing section of the platform.
ElevaTechPro may adjust subscription pricing with at least 60 days written notice before the change takes effect. If you do not agree to the new pricing, you may cancel before the new price takes effect.
Subscription fees are non-refundable except as required by law. If you believe a billing error has occurred, contact us within 30 days of the charge.
You retain full ownership of all data you enter into the ElevaTechPro platform, including unit records, inspection reports, customer information, and work order history ("Your Data").
By using the platform, you grant ElevaTechPro a limited, non-exclusive license to store, process, display, and transmit Your Data solely as necessary to operate the platform and provide the services to you. We will not use Your Data for any other purpose without your consent.
You are responsible for ensuring that the data you input into the platform is accurate, complete, and obtained in compliance with applicable privacy laws.
ASME inspection reports, violation records, and MCP maintenance logs created through ElevaTechPro are subject to mandatory retention requirements under ASME A17.1 and applicable state elevator safety regulations. These records will be retained by ElevaTechPro for a minimum of 10 years even after account closure. Retention of these records does not constitute continued provision of the full platform service. You may request access to retained compliance records in writing after account closure.

ElevaTechPro reserves the right to suspend or terminate accounts that violate these terms without prior notice.
ElevaTechPro targets 99.9% platform uptime, measured monthly, excluding scheduled maintenance windows.
Uptime commitments do not apply to outages caused by factors outside our reasonable control, including third-party service failures, internet infrastructure disruptions, or force majeure events.
ElevaTechPro is a software tool that assists elevator maintenance contractors in managing compliance workflows. It does not replace professional engineering judgment.
ASME checklist content and inspection results generated through the platform must be reviewed and approved by a licensed Qualified Elevator Inspector (QEI) before submission to any Authority Having Jurisdiction (AHJ). ElevaTechPro is not liable for inspection outcomes, AHJ decisions, certificate denials, regulatory penalties, or enforcement actions. The platform provides tools to assist your compliance workflow; final responsibility for compliance rests with the licensed contractor and QEI of record.
To the maximum extent permitted by applicable law, ElevaTechPro's total liability for any claim arising out of or related to these Terms or the platform shall not exceed the amount you paid to ElevaTechPro in the 12 months preceding the claim. In no event shall ElevaTechPro be liable for indirect, incidental, special, consequential, or punitive damages.
ElevaTechPro owns all rights, title, and interest in and to the platform, including its software, design, user interface, documentation, and all associated intellectual property. Nothing in these Terms transfers any ownership of the platform to you.
You own Your Data. ElevaTechPro owns the platform.
ASME A17.1, the Safety Code for Elevators and Escalators, is owned by the American Society of Mechanical Engineers (ASME). Checklist content derived from ASME A17.1 is used in the platform under license. ElevaTechPro does not claim ownership of ASME standards content.
Either party may terminate the subscription with 30 days written notice.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
